the Federal Commission of competition (Cofece) imposed a fine of 418 million 309 thousand pesos to Industrial transformation Pemex (Pemex TRI) for violating a commitment to protect and restore competition in markets of oil when applied for the early closure of an investigation by a possible anti-competitive practice.
The company was investigated in 2016 for the possible realization of relative monopolistic practices, however, it requested the early closure of the investigation (record of-002-2015) and, in return, pledged to carry out various actions to restore the conditions of competition.
“In 2015, Pemex TRI was denounced before the Commission by the possible realization of relative monopolistic practices, specifically by discrimination of treatment. I.e., by not providing the same conditions of supply and sale of first-hand diesel marine special to this fuel distributors in equality of circumstances”, details the Cofece in a statement.
However, Pemex TRI freshly delivered a report which Cofece would verify the actions to eliminate the behaviour for which the company was investigated.
The objective of the report is to verify that the company of the same treatment in the sale of first-hand all competitors participating in these markets.
The delivery of the report, in terms of the resolution of commitments, has to occur during the first three months of each year for a period of five years calendar, starting from the first quarter of 2017. However, the first report was delivered extemporaneous way, with nearly a year of delay.
For this reason, the plenary declared non-compliance to a part of the commitments entered into by Pemex TRI and therefore imposed the fine.
