the Congress of Yucatán will discuss this week the initiative that seeks to legalize the equal marriage in the State.
This, once the Commission of constitutional issues and governance of the Yucatan Congress overwhelmingly approved the opinion proposed to modify article 94 and 49 of the State Constitution, thus the article 201 of the family code, which establish that the only marriage is “a man and a woman”.
If approved the initiative in full, delete paragraphs that say that “marriage is an institution by means of which sets the legal union of a man and a woman, with equality of rights, duties and obligations, with the possibility of generating the” human reproduction of free, responsible and informed manner”.
It also proposes to change the paragraph which says that “the State recognizes that it is of vital interest to the society that the Union of man and woman for procreation, established limits in terms of the age and physical and mental health. Concubinage is the union of a man and a woman, those free from marriage, who live as spouses and can generate a family, in the terms established by the law.”
The initiative must be approved by three-quarters of the Congress, so that then proceed to the reform of the Civil Code and the family code of the State, as well as in secondary legislation which establishes the same restrictions.
He is expected that the initiative be resolved before the next April 15 when it concludes the current period of ordinary sessions.
In the past seven years, deputies tried to legislate the civil marriage regardless of sex or gender through three initiatives definition, however, neither prospered.
During the session, which was attended by all the legislators, not held any discussion and simply put the opinion to the vote; It was only rejected by the deputies of the PAN Rosa Adriana Díaz Lizama and Miguel Rodríguez Baqueiro.
The PRI Felipe Cervera Hernández, Karla Franco Blanco and Luis Borjas Romero, as well as the Member of convergence, Silvia López Escoffié spoke out in favour of the opinion.
