The Constitutional Court (TC) admitted to process the required Unconstitutionality of the Statute of the International military Tribunal of Nuremberg, concerning the applicability of crimes against humanity.
The pending management affects the process of immunity followed before the minister in visit of the Court of Appeals of Santiago, Miguel Vásquez Plaza, in which the requester (Officer of the retired Army), has been condemned as author of the crimes of simple kidnapping and Qualified homicide perpetrated against Victor Jara Martínez and Littré Quiroga Carvajal, both considered against humanity.
To the effect, it should be recalled that the applicant argues, in short, that the contested statute violates the principle of juridicidad and due process, since it considers that it is being tried for a penalty that was not typified by a law enacted before the Crime. To a greater abundance, it explains that the standard that enshrined in Chile the applicability of the crimes against humanity came to rule in the year 2009.
In its resolution, it states the constitutional judiciary that the antecedents examined allow to conclude that it complied with all the requirements demanded by the Political Constitution, in relation to the envisaged in the LOCTC.
In the case declared admissible, it shall be for the full court to issue a statement on the merits of the challenge.
Reactions
Former deputy Secretary of foreign affairs, Alberto van Klaveren, reacted to this news and noted in his Twitter account that “let’s hope that only by formal question, resource that questions statute of the Tribunal of Nuremberg!
