A man who sexually abused a child under 11 years of age in an IMSS hospital in Ciudad Juarez, Chihuahua, received a sentence of only 6 and a half years in prison when she should have been 30 years old, thanks to the defendant getting the benefit of the proce abbreviated disign.
The abbreviated procedure is that “if the accused acknowledges to the judicial authority, voluntarily and with knowledge of the consequences, his involvement in the crime and there are sufficient means of conviction to substantiate the allegation, the judge will cite a sentencing hearing. The law will establish the benefits that may be granted to the accused when he accepts his responsibility.”

In addition to the sentence, the sentenced, identified as Ricardo Israel Ortiz Narváez, will have to pay a fine of 12 thousand 800 pesos for damage repair. 
The sex crime occurred just over a year ago, on June 17, 2018, at IMSS Hospital 35 located in Ciudad Juarez.
According to the indictment, the minor boarded the hospital elevator to say goodbye to her grandfather who was ill with cancer, when the doors closed the sentenced stopped them and managed to get in.
The victim reported that when they were both left alone in the elevator, Ortiz Narváez sexually assaulted her, she defended herself but he continued.
Faced with this, the youngest descended on the first floor but the assailant followed her, reached her on the stairs and there she committed sexual abuse, with the threat that if she defended herself she would kill her.

The child’s mother stated that seeing that her daughter would go alone in the elevator with a stranger she decided to climb the stairs to reach her and make sure she had arrived well.
However, when she reached the first floor she found her daughter crying and recharged on the railing of the stairs. When she saw her mother, the youngest screamed to have the police called and the rapist tried to flee but was hit by the mother and some vendors who heard the child’s screams.
After a year of prosecution against the rapist, on Wednesday a local judge in Ciudad Juarez handed down the sentence of six and a half years in prison and the fine of 12,800 pesos for the crime of rape with aggravated penalty. Had he not obtained the abbreviated procedure, Ortiz Narváez would have received a sentence of 30 years.
