The only defendant in the costanera accident that cost April’s life and Agustin Kruk asked for home prison and confronted the children’s parents during Tuesday’s hearing.

In testifying for the first time, José Osvaldo Caccia (28) apologized. “I didn’t do it on purpose. I dodged the truck to protect my family. I didn’t run away from the place and helped in what I could,” he said. The mother of the deceased boys, Carla Pagliaricci, spewed it untetheredly: “I don’t believe you and I don’t apologize. You can’t look me in the face. If you saw us and your wife told you to point it at us,” she opined. Her ex-husband, Miguel Kruk, didn’t admit nuances either. “You don’t drop a tear,” he said. You accelerated, you didn’t slow down, you didn’t care about anything.” Pagliaricci added that Caccia seems to him “a cynic”: “I’m not going to forgive him as long as he lives,” he said, Domiciliary?
Meanwhile, the defense follows its strategy. In August, he applied for Caccia to go to house prison, postulating that “there is no risk of escape.” At that time the request was denied. On Tuesday, lawyer Carlos Moyano insisted for the fourth time on the subject. The lawyer posits that the defendant has family and work roots in Mendoza, so from his perspective he could join the 700 people in the province who are serving their sentences in their homes with electronic anklet. But Fernando Giunta – traffic prosecutor- and Mariano Tello – a lawyer in the file – oppose. Among other things, because the defendant’s address is 500 meters from where the children’s mother Kruk lives.Judges Luis Correa Llano, Mateo Bermejo and Ariel Spektor will take a few days to decide on that point. Tragedy
The accident occurred on the afternoon of December 14, 2018, when Carla was crossing the Costanera with her children. Arriving at The Matienzo Bridge, a series of mistakes detoned the tragedy. An Iveco truck, a VW Gol – in contrast, uninsured, unpaid and driven by a man-alcoholized – and a ford Fairlane coming at high speed were found at the site of the three victims. Caccia, who was in charge of the old Fairlane, wanted to dodge the other vehicles but took the children and their mother. For now, the only defendant is Caccia, who risks 8 to 25 years in prison for simple manslaughter with eventual will and serious injury. The other two drivers were overturned, although that decision must be upheld by the Supreme Court.Indignation
For a number of reasons, the case arouses the outrage of many Mendozas. A few days ago, Rodrigo Peca Flores, the VW Gol driver who was coming in hand on the day Augustine and April died, was arrested by road police when he made a “U” in Lemos de Guaymallén street.When the officers asked him for the papers, they discovered that Peca Flores still didn’t have insurance or a driver’s license. He was driving out of the law again, as if nothing.
