Mexico.- Through a statement, it was reported by the Supreme Court of Justice of the Nation (SCJN) that it has already validated on Tuesday, October 5, the precepts that establish that a person can injure or even cause death by defending himself from an aggression, in three entities in Mexico.
“The Supreme Court of Justice of the Nation (SCJN), in session of the Full Court, validated the legal portion injury or even the deprivation of life, of the second paragraph of Article 25, fraction III, of the Penal Code of Veracruz, in considering that it does not create legal uncertainty or allow individuals to take justice in their own hands,” he said in a statement.
He added that the precepts regulate self-defense in the states of Veracruz, Baja California and Nuevo León.
However, the SCJN cautioned that even if this provision establishes a presumption of self-defence in certain cases, this should not be interpreted as meaning that individuals may make use of force indiscriminately, or that liability can be excluded where the damage to the aggressor has proved unnecessary or excessive.
“This, since the precept itself is clear by pointing out in its first paragraph that in order for the self-defence to be updated, there needs to be a rational need in the means used to repel aggression,” he said.
With those same arguments, the Plenary of the Court also validated the second paragraph of Article 23, paragraph II, of the Penal Code for the State of Baja California, which lays down the requirements for the existence of self-defense to be presumed.
As well as article 17, fraction III, the last paragraph of the Penal Code for the State of Nuevo León, where this same subject is regulated.
