The plenary of the TEPJF Specialized Regional Chamber established that “servers of the nation” did engage in “government propaganda with elements of personalized promotion and misuse of public resources”, by delivering social programs with clothing in which the name of President Andrés Manuel López Obrador was identifiable.
“In the resolution, no liability is attributed to the President of Mexico, because he did not authorize the use of his name and image, nor did he participate in the reported facts. Nor was that responsibility given to the Morena political party,” the Court said, on the decision of the Specialized Chamber.
“As for María Luisa Albores González, head of the Welfare Secretariat, and Gabriel García Hernández, general coordinator of Development Programs of the Federal Government, it was concluded that they are not responsible for the violations since the execution of the social programs is the responsibility of the holders of the State Delegations,” he added.
The Regional Chamber detailed that “36 public servants (in delegations, regional sub-delegations and ‘servants of the Nation’) conducted acts of government propaganda with elements of personalized promotion and misuse of public resources with the delivery of social programs, which were also disseminated on various social networks of these public service persons and in journalistic notes”.
In addition, it noted that the reported government propaganda could violate the best interests of children, as several publications show the image of children, “without the consent and opinion of both girls and boys, as well as the father or guardian”.
The Court recalled that the complaint in this case was filed by the PRD. 
“From the point of view of the PRD, an alleged campaign was implemented in which staff of the Welfare Secretariat (delegations, regional sub-delegations and ‘servers of the nation’) carried out various actions, such as the lifting of a census and the distribution of social programs, through which they promoted the name and achievements of the president of Mexico and the Morena political party, in order to position themselves politically and electorally in front of the population and influence the upcoming local electoral processes and federal syllade.”
In addition, for the development of these activities, the PRD added in its indictment, “they carried vests, backpacks, caps and gafetes, and visited the public at their homes, with the purpose of registering potential beneficiaries and handing over bank cards for such social programs.”
On August 16, the Complaints and Complaints Commission of the National Electoral Institute (INE) ordered the suspension of the use of the name of President Andrés Manuel López Obrador in clothing and accessories such as vests, caps, backpacks and baglasts used by the nation’s servers.
Electoral counselors agreed that the nation’s servants conducted a personalized promotion of the president, in violation of constitutional article 134.
This article prohibits any government propaganda from having names, images, voices or symbols involving personalized promotion of any public servant.
