The Secretariat of Environment and Natural Resources (Semarnat) lost a legal battle against the company Peninsula Maya Developments, in which it must cede 53.8 hectares of protected area of the Big Island, in Holbox, Quintana Roo, for “overlapping” with company plots.
The environmental authorities published three agreements in the Official Journal of the Federation, of 2 January 2020, in which they terminated an agreement that intended these Holbox properties, in the municipality of Lázaro Cárdenas, Quintana Roo, to the National Commission of Protected Natural Areas (Conanp).

Only areas covering one of the 63 plots belonging to the Mayan Peninsula will be unprotected, according to the official publication.
The cancelled agreement was published on May 2, 2016, which is why the company filed indirect protection 548/2017 on the grounds that its property right was violated, in zone one of the Ejido Holbox.
The battle was resolved on July 3, 2019 by the Second Chamber of the Supreme Court of Justice of the Nation, who granted the shipper the protection.

Peninsula Maya is owned by Fernando José Ponce Díaz, owner of Grupo Bepensa, with presence in 27 states. In 2014 he withdrew from Semarnat the application to obtain the Environmental Impact Manifestation of the tourist project “La Ensenada”, which he intended to build on the island of Holbox, because it is an area of protection.
