The Technical Council of the Mexican Social Security Institute informs that it agreed to disseminate the legal and administrative instruments with which IMSS counts to facilitate the correct payment of the labor-employer fees, within which are the following:
First: IMSS fee partial payment agreement provided for in Articles 40-C and 40-D of the Social Security Act. In this regard, guidance mechanisms are established to facilitate the subscription of such agreements, on the understanding that the starting amount to be covered will be 20 per cent of the employer’s quota and 100 per cent of the worker’ quota, the remainder may be deferred up to a maximum of 48 months.
The amount agreed to be paid to biases is unchanged and being a payment received outside the legal deadlines, generates updates and surcharges.
The benefit of entering into this agreement is that the monthly term interest rate ranges from 1.26 percent to 1.82 percent, depending on the chosen term (12, 24 and more than 24 months) from the time of formalization.
Second: No guarantees will be required for the subscription of that agreement, this under the authorization granted through the Agreement of the Technical Council number ACDO. AS2. HCT.300419/150.P.DIR, 30 April 2019.
Thirdly, if the agreed commitments are covered in a timely manner, fines may be reduced in accordance with the agreement of br Technical Council 187/2003, published in the Official Journal of the Federation on 15 July 2003.
Fourth: Section 31 of the Social Security Act provides for the discount of up to 7 days for absence in cases of absence of the worker where the employment relationship persists. During these days the fee corresponding to The Health and Maternity Insurance will be paid.
Fifth: In accordance with the declaration of health emergency due to force majeure decreed by the health authority due to the epidemic caused by the SARS-COV2 virus disease (COVID-19), they were defined as safe days for the practice of proceedings, hearings, notifications or requirements, the period from 31 March 2020 to the date on which the Technical Council determines that the causes giving rise to it have ceased.
