Morelia, Michoacán.- At the meeting of the Judicial Commission, and Constitutional Points and Parliamentary Regime, the initiative carried out by the Deputy of the Congress of Michoacán, Sergio Báez Torres, raised with the purpose of exhorting them to officials and dependencies, was approved, be answered by the points.
In the proposal made known by the legislator emanating from the National Regeneration Movement (Morena) party, on December 12, 2018, Báez Torres considered that the exhortations are only synonymous with the positions presented by the Members, so they have no legal consequence and end in “calls to mass”, without having any resolute value.
During the explanatory memorandum to reform section 236 of the Organic Law of congress, the Moranist noted the following:
“The exhortation is a mere positioning assumed by the Senate of the Republic as an institution with regard to the matters that motivate it, which in no way can be mandatory or generate legal consequences (…) These are purely political issues that are not subject to constitutional control.”
In addition, the intention of the Morena Congressman’s initiative is to increase the institutions’ response capacities, as well as to strengthen the principles of cooperation of powers.
The members of the committees mentioned included the initiatives of Ms. Sergio Báez and Ernesto Núñez, in the opinion adopted today.
