President Andrés Manuel López Obrador explained on Monday the steps to take to request a public consultation deciding on the prosecution of former presidents, and even saying deadlines to comply with the process.
When questioned about the investigations of Emilio Lozoya and Genaro García Luna, the representative pointed out that in both cases there are three priorities: that the whole truth be known; the return of the stolen money, and that a consultation be requested so that the former presidents can be prosecuted in case their involvement in any crime is proven.
“What I’m proposing is that at the same time that the Attorney General’s Office and the Judiciary are stirring, a consultation can be made, that it is the people who decide, that we decide them among all,” he said.

The Chair explained in detail the steps to be taken to request such consultation on the basis of the law. 
According to López Obrador the request can be made by the president; representative of one of the cameras; or through the signatures of 2% of citizens registered on the electoral roll. The deadline for filing the petition is from 1 to 15 September.
In the event that the application is par with the president or a legislator must be approved in the chambers, “I am not sure if it is a simple majority or two-thirds,” he said.
But if the petition is given through citizen firms it “does not pass by approval of cameras”, but goes directly to the Court and it rules if it is constitutional, and if applicable goes directly to the INE to organize the consultation. 
If the process is followed and the consultation is approved the date for it is made, according to the president, June 6 (the day the next election is held) or August 1, 2021.
“I’m reporting on time, it would be best for the firms to be provided by citizens (…) the second possibility is for lawmakers to do so, and the third is for the president to request them. I’m going to decide to the end but I don’t miss the possibility of doing it,” he added. 
The Chair said he was confident that in the coming days the FGR will offer further progress in Lozoya’s research, which would let us know whether or not it will be necessary to investigate the expressers.
