“The background examined by this Court makes it possible to verify that the requirements of Article 93(17.997), constitutional organic of the TC, have been met in relation to the provisions of Articles 83 and 84 of Law No. 17.997, Constitutional Organic of the TC, to declare it admissible,” says the text of the decision of this 15 October recorded by The Third.
“The request is declared admissible,” the document adds.
The Second Chamber of the TC accepted the appeal brought by the defense of the secretary of the Senate but refused to stay the proceedings against him. Now, the Regional Prosecutor of Biobío will have no obstacles to continuing the investigations and formalizing Guzman.
It should be noted that the legislation states that “he who endangers public health for breach of hygiene or health rules , (…) in times of catastrophe, epidemic or contagion, you will be punished with a smaller prison to its minimum to medium degree or a fine of six to two hundred UTM.”
In addition, the parties to the process were conferred ten days to comment on the admissibility of the request.
The formalization hearing against Guzman will be held on November 19.
