As part of the launch of its Observatory on Rights, the Ombudsman’s Office presented Technical Note No. 2, which reveals little progress in the judicial cases of children and adolescents who were victims of human rights violations during the social outburst.
“The State of Chile has a duty to investigate and punish human rights violations committed by state actors, which derives from its duty of general guarantee of human rights,” says Children’s Advocate Patricia Muñoz, adding that this Technical Note seeks to show the status and progress in investigating such crimes.
This analysis, based on information provided by the Public Prosecutor’s Office, details, interless other information, that of the 1,498 cases received by that body, only 3.8% of them have any known defendants, and 1% of the total has formalized.
Moreover, of the 170 complaints submitted directly by the Children’s Ombudsman’s Office to the Public Prosecutor’s Office, only 29% of the relationships have been contacted to give evidence, and only half of those relationships (51%) victims have been referred to the attention of specialized professionals to determine their situation and protectional need.
In this line, the Ombudsman noted that what was described “evidences the existence of serious fallacy in the investigative processes of causes of public interest and of particular concern for the country, as they are violations of the human rights of children and adolescents”, adding that this fails to make progress in obtaining truth and access to justice.
In addition to publicating this data, the Children’s Ombudsman outlines recommendations and challenges in this area for both the Public Prosecutor’s Office and the Executive.

All this data were collected and analyzed within the framework of the Observatory of Rights of the entity, which arises from the function entrusted to it by Law 21.067: “4th i) Observe and follow up on the actions of the bodies of the State Administration, legal persons who have as their object the promotion or protection of children’s rights and organizations that may affect such rights with their actions”.
Faced with the need to systematize this work and to inform citizens about the implementation, monitoring and realization of the human rights of children and adolescents living in the country, this Observatory emerges, which gives an account of the situation of all the rights of children and adolescents in Chile, not only cases of human rights violations.
