Former Health Minister Jaime Mañalich referred to the complaint filed against former Clinic general manager Las Condes Fredy Jacial, who is accused of receiving “excessive” Covid Fonsasa patients.
In conversation with Radio Cooperative, Mañalich assured that this situation gives him “shame” and that he “justifies renewing the state of emergency” in order to avoid blockages of patients derived from other care facilities.
“Faced with this threat that there could be a health care provider who refuses to receive patients who are derived from the State, regardless of their foresight or funding (…) forces in practice, in the winter months, where we are obviously going to have a third wave, that this power given to the Ministry of Health by the state of emergency is renewed,” he said.
“Obviously, I am ashamed because I participated in the administration of that institution at some point, the doctors of that institution are not in this attitude, they have been – even Dr. Tomás Regueira, who president of the Chilean Society of Intensive Medicine and was director of the Critical Patients Unit – was always received from all the patients who derived” Added.
“While I was Minister of Health and on the merit of the constitutional state of emergency of catastrophe, in practice measures that are in the organic law of constitutional states of emergency were used and in practice a system was set up structured from the Undersecretariat of Assistance Networks to use article 17 and following the law” Explained.
Mañalich closed by stating that this article “authorizes the State to requisition property or impose limitations on the exercise of the right to property, independent of the fact that the person who has been the subject of that limitation may then bring a claim for damages against the tax in a civil trial”.
