Comptroller warned that municipalities do not have powers to sell liquefied gas

The Comptroller General of the Republic issued an opinion in which it warns that the initiative promoted by the municipalities to sell gas at an affordable price to neighbors is unconstitutional. The response of the supervisory body to the municipalities of Lo Padro, Conchalí and Pelarco maintained that “the municipalities may develop business activities or participate in them only if a qualified quorum law authorizes them, which has not taken place in the species.” The sale of gas to its neighbors can only be carried out to the extent that the legislator expressly authorizes it,” he added, that is, the regulations must be modified by Congress so that the initiative is concretized. He also maintained that “it should be stated that the sale of gas for which it is consulted is a different situation from that analyzed with respect to communal pharmacies, which are covered by the functions of primary health care that the legislator expressly located in the building entities”
