TEPJF confirms fine to AC for improper promotion of Revocation of Mandate

The Plenary of the Superior Chamber of the Electoral Tribunal of the Judicial Power of the Federation (TEPJF) confirmed the determination of the Specialized Regional Chamber, to fine the civil association “Que siga la democracia”, for improperly promoting the process of the Revocation of Mandate.
According to a complaint filed against Morena and “Let democracy continue” by the National Action (PAN), Democratic Revolution (PRD) and Citizen Movement parties, for disseminating the process, stating that it is a “ratification” of the position.
In this regard, the National Electoral Institute (INE) issued an agreement in which it declared the origin of precautionary measures, consisting of ceasing to use the word “ratification” in the association’s propaganda.
However, some time later the Complaints and Denunciations Commission of the INE determined that the civil association continued with the dissemination of propaganda with the text “Ratification”, so the Electoral Institute opened an investigation process.

In this case, the Specialized Regional Chamber of the TEPJF ruled that the organization failed to comply with the precautionary measure, for which it imposed a fine. In response, the association challenged the decision.
In session by videoconference, this Wednesday the plenary session of the Superior Chamber, at the proposal of Judge Indalfer Indante, considered that the claims are not appropriate, because it was found that the association did not perform the necessary acts to comply with what was mandated by the authority.
The ruling issued by the Electoral Tribunal stressed that it was not enough for the organization to deny having installed the modules in which the sanctioned propaganda continued to be used, because its name was used so it had the duty to prove that it had no relationship with the people who installed them so that it could be exempted from responsibility for the violation of the precautionary measure.
