Mother linked to trial after reporting the father of her daughters of abuse

Two years ago, Monica Peyro filed a criminal complaint against the father of her daughters for sexual abuse and rape against the girls. But even having the opinion of a forensic doctor who reviewed the youngest daughter and determined that the girl had suffered anal penetration, the judge decided to dismiss the case and not exercise the criminal action. On the other hand, now the mother has been linked to trial after her ex-husband and alleged aggressor of the minors accused her of family violence. 
The complaint against Mónica Peyro, her brother and her father is for having gone out to the media and for making publications on social networks denouncing sexual abuse and rape and asking for justice for the girls, which caused the father an alleged psychological damage.
This Saturday, April 30, a control judge linked Peyro and his brother to trial; that is, they are already accused of probable responsibility for the act. The Public Prosecutor’s Office requested two months to carry out the complementary investigations.

Meanwhile, the judge ordered Peyro and his brother not to have more communication with the media and download all the publications made about the case on social networks, so the woman decided to close her twitter account and not give more interviews. 
In a previous conversation with Animal Político, Peyro said that all this is a retaliation for having made public the case of sexual assault against the girls and for pointing out, even before deputies in the local congress of Durango, where they live, that the authorities have acted to favor the alleged aggressor for being a prominent businessman of the state, and because of the political ties of his father. 

Alvaro León, Peyro’s lawyer, denounces that this is a case of influence peddling and, therefore, there are many irregularities in the process. The crime they are accused of, he says, is for family violence, which occurs when there is intentional omission or acts of power, so the judge interpreted that they were exerting psychological violence on the father of the girls in networks and that was an act of power. 
In addition, it determined that the alleged psychological damage was also for the daughters of Mónica Peyro, due to the exposure in the media and networks of the case of abuse and rape of which they were victims. 
“The publications in networks that Monica and her brother made do not give to allege that it is family violence, the abuse of power here does not exist. In addition, there is not even an expert opinion that says that the accounts are theirs, the judge was enough as evidence that his photograph comes out, “says the lawyer. 
Another thing that Álvaro León complains about is that supposedly the judge already had his written resolution, “he was reading it, we realized that, it is not that he has decided before the arguments of the defense and the public ministry, he already had his resolution and only discarded all my arguments and evidence.” 
What Monica and her lawyer will do now is appeal the link to the process. “As the appeal falls on the local judges, if it is unfavorable to us, we will have to resort to amparo,” explains León.
Selective justice
In October 2019, Monica Peyro filed for divorce from her then-husband. On November 29, 2019, still living in the same house, he went through the girls to school and did not return them to the family home. 
That same day, the father of the minors filed a lawsuit for divorce and custody and parental authority, “alleging that I am not well of my mental faculties, that I am always doped by it, and that I have not been taking care of my daughters. In six working hours they grant him custody, the girls being stolen and out of state,” the mother said in a previous interview with Animal Político.  
Peyro filed the complaint for child abduction and went to the Prosecutor’s Office to do a psychological and toxicological examination, in which she was suitable for the role of mother, although with features of depression and anxiety, but for the disappearance of the minors. Monica also managed to verify with photos and videos that she has always lived with her daughters and has taken care of them. 
Finally the father of the minors was linked to the process for illegal abduction, but he pleaded guilty and requested the suspension, the judge granted it and Peyro asked the judge to return his daughters, to which he replied that he could not do it because a family judge had already granted custody to the father. 
Monica went to a criminal judge to claim custody and was granted, so together with the authorities, Peyro went to the house of the paternal grandparents where the girls are supposed to be, but they did not find anyone. 
The next day, Peyro said in the previous interview, lawyers for the girls’ father soughtn to hers and told them that Monica could see her daughters again if she signed an agreement, which included joint custody of the minors: four days with her father and four days with her, in addition to the vacation distributed equally. 
It was in that period that Peyro began to notice changes in the behavior of her daughters, which made her suspect a probable sexual abuse. On April 17, 2020, she filed a complaint for this crime against whoever is responsible.
Until a forensic doctor certified that the youngest of the girls had signs of anal penetration, she filed the rape complaint, on August 11, 2020, against the father of her daughters because one of them pointed it out directly.
It was that complaint in which a judge ruled that the forensic doctor was wrong and that what the girls were referring to were nothing more than “acts of love of their father” and made the dismissal and the non-exercise of the criminal action. 
But the process continues, since Monica Peyro challenged the judge’s decision. Only now she fears that she is the one who goes to jail and her daughters will be under the guardianship of their alleged aggressor.
