Mexican standard regulating remote workers

The official Mexican standard 037 (NOM 037) regulates the conditions of safety and health at work via remote is in force as of July 15 in the country, in order to establish the preventive conditions in teleworking. It was generated from the reforms to Article 311 of the Federal Labor Law, which entered into force on January 12, 2021, when the labor authority recognized telework or home office as a modality of employment. Rule that obliges companies to have a list of employees, whose remote work represents at least 40 percent of the weekly working day. The company has to create the internal policies that regulate both the employer and the employee so that the activities are carried out in a timely manner. It is important in the list of employers remotely to include: address and agreed places of work with the employer, full name, sex, position, telephone number, address and activities to be carried out. The obligations of companies to people who work remotely are: provide the worker with an ergonomic chair, necessary supplies to carry out activities such as computer equipment, maintenance of the same and constant training. Within the established business standards there is a support resource in terms of electricity and internet services, however, it is not yet clear how this support should be handled, since the amount depends on the place where the activities are being carried out. Workers remotely have the obligation to provide the employer with a physical check of the safety conditions of the workplace, whether it is a suitable space within the place, a coworking space, cafeteria, among other spaces suitable for teleworking. Continuously inform the employer of any situation that may put the worker at risk, physical conditions in the space, health, as well as the optimal protection of the furniture equipment. The Ministry of Labor and Social Welfare (STPS) within this standard, asks companies for a balance and respect for schedules so that people can count on flexible working hours.
