Trial for the murder of Fernando Báez Sosa: Burlando said the murder was “planned”

After 3 pm, the lawyer of the Báez Sosa family, Fernando Burlando, began the defense argument after the Public Prosecutor’s Office has requested life for the eight accused for the crime of Fernando Báez Sosa. The lawyer stated that the murder that took place on January 18, 2020 in the seaside resort town of Villa Gesell was “planned.” During the defense argument, the lawyer of the Báez Sosa family expressed his main thread of the argument: “What there was was a planned murder, a coordinated criminal action, a murder in the worst of states that a human being can have, which is the state of defenselessness; and also practiced in a treacherous manner.” He added: “They also indulged in accusing an innocent person. Fernando Báez Sosa asked for clemency and was not given. It is enough to see and hear the evidence to understand that he asked for compassion and was not given. Far from it, they kept beating him. They sought death with blows that were shots from guns: every blow was a shot, every kick a shot. He was shot by beating and kicking.” All this cruelty had as zero page a simple and accidental push in a place where it was impossible to walk. In this context, Fernando had offended the leader of the pack: Máximo Thomsen, whom the others accompanied proactively, “said Burlando, who also dedicated a moment to the “leader” and relying on a video that was analyzed during the hearing said that Thomsen: “In light of the evidence obtained, he announced the outcome with the gesture of the finger passing it from left to right. Where this death threat is then verified.” In the almost two hours that Burlando’s argument was extended, the lawyer was very punctual with the descriptions and tried to relate every moment of the murder. He affirmed that the accused had “the will to kill” and that is why they “killed” Fernando, at the same time that he explained that they set up a “human fence to act on insurance and be sure that his victim was not going to be able to count on the help that his friends wanted to offer him”, but they could not since they did not manage to pass the “siege”. At the time, Burlando focused particularly on four of the defendants and their roles within the beating: “The order was given by Ayrton Viollaz, he said, ‘It’s now.’ It is not something minor to give an order that causes a death. Enzo Comelli and Ciro Pertossi advanced to the goal and Máximo Thomsen did his thing. The rest of the executioners fulfilled their role in the crime: all beating him, all killing him, all murdering him.” In addition, he recalled that Fernando was grabbed from behind and affirmed that the defendants had “an oiled mechanism” for which “they did not improvise a single movement: they already knew the protocol of the manual of ‘Los demoledores'”, in reference to the actions of the accused before the crime, according to witnesses who would have attacked previously in Zárate. “The celebrations came. The organization of a meeting with flowers, wine and marijuana.” He also devoted his moment to the incrimination of Pablo Ventura, the falsely accused rower.” One wonders why they killed: they killed for the sake of killing. It really is inexplicable. They didn’t care whom. His plan was to take it as a trophy. The synchronized coordination of actions allowed them to build an impassable wall,” said Burlando, while adding that the “voracious carnage lasted for approximately 50 seconds, that was the time it took the murderers to beat Fernando to death.”
