translated from Spanish: Demand Congress of Yucatán for equal marriage

The collective for the protection of all the families of Yucatan (collective PTFY) presented two requests for amparo against the State Congress for refusing to approve the equal marriage in the State.
On April 10, the plenum of the local Congress rejected the reform to article 94 of the local Constitution to does not restrict marriage to the union of a man and a woman.
The vote of the deputies and members held in secret, on the proposal of the directive Board of the Congress.
The two demands of amparo were filed on April 22.
“The first demand, which will be resolved by the first District Court, was filed against the decision to vote in secret way equal marriage initiative, without that I could learn about the sense in which each of the legislators voted” said the group, in a statement.
While some members of the legislature had made public its position on the issue, the single vote in secret violates human rights and is undemocratic, said Alex Orué, spokesman for the collective.
The trial of amparo against the secret ballot, they said, take it together with the organization Article 19 Mexico, specializing in issues of freedom of expression.
“The second lawsuit filed, which will be resolved by the Fourth District Court, raises that the decision not to approve the equal marriage violates the Federal Covenant to comply with as ordered by the Supreme Court of Justice of the nation and the Court Inter-American human rights”, explained Carlos Duarte Escoffié, lawyer of the group.
“While the Supreme Court of Justice of the nation has already said that to comply with the Federal Constitution equal marriage should be allowed, the Congress of Yucatán decided that that part of the Federal Pact not going to comply and may arbitrarily select what “things will make a case to our highest court and what not”.
Both demands of amparo, said the collective, already were admitted into the courts and the Congress of Yucatan already should have been notified.
“Of the 36 people who demanded the Congress in both trials, most are members of the community LGBT +. Others are activists of academics, and human rights as well as relatives of LGBT people “, referred in his statement.
