In the last two weeks, two afew rulings by the Arica Court of Appeals led to the annulment of decisions seeking the expulsion of 72 foreign nationals who entered the country by unqualified steps.
The expulsion orders were issued by the mayors of Arica and Parinacota, Tarapacá and Metropolitana, a no minor data, as it reveals the differences of public bodies with regard to the guarantees of the migrants who entered the country between 2018 and 2019.
According to El Mercurio, last week, the second courtroom, in divided ruling, hosted an appeal filed by the Jesuit Migrant Service (SJM) that benefited 34 foreign citizens. In addition, this week and unanimously, the first room of the same court benefited 38 other foreigners.
In this regard, the regional mayor of Arica, Roberto Erpel, noted that “they have the power and the obligation to enforce the laws. Not expelling for clandestine entry establishes a cloak of impunity in the face of this practice and brings significant risks to the security of the country and to the migrant himself.”
“International gangs of human trafficking can be encouraged, as clandestine entry could not be sanctioned,” Erpel added.
Meanwhile, the mayor of Tarapacá, Miguel Angel Quezada, argued that “we have emphasized that it is not possible to control if the person is who he claims to be, if he has a criminal record before entering the country”.
