Morelia; Michoacán. – Public servants can only do what is legal; therefore, they must approve the candidacy of Raúl Morón, since the order not to register it by the National Electoral Institute (INE) is illegal, disproportionate and has a high degree of political bias, carlos Torres Piña said.
In this context, Electoral Councillors are not obliged to abide by arbitrariness or manifest illegalities and, in this case, it is an illegal and arbitrary decision of the INE, which they must not comply with and rather denounce.
It is clear that the INE did not follow due process or the timetable established.
The illegality is realized because from Wednesday, February 03, 2021 – deadline for the delivery of the reports-, in the face of evidence of expenditure and omission of reports, the INE should have required Morena to enable a precampal account in the SIF system, which it did not do.
On the contrary, in the period from 15 to 22 February – period of notification of errors and omissions, as well as the response of errors and omissions, which it does not apply because there are no pre-campaigns – the national electoral management body ordered the Technical Control Unit (UTF) to require obligated subjects, to be placed in the event of omission in the report of operations and/or reporting, so that within an unbreakable period of one calendar day, they record their operations, and submit the precampagna report.
In the NOTIFICATION of the UTF you must expressly inform the regulated subjects that, if they do not submit their report through the SIF, the legal consequence of such non-compliance will be the refusal of their registration as a candidate.
In the event that the IEM reversed the registration of Raúl Morón, a Trial for the Protection of the Electoral Political Rights of citizens (JDC) may be filed per saltum, before the TEPJF to accumulate with the one already presented. This trial has the virtue of skipping all instances and saving time to safeguard electoral political rights.
