On Tuesday, the Ministry of Finance and Public Credit made official the disappearance of the Natural Disasters Fund (Fonden), by publishing the agreement abrogating the various by which the General Rules of the fund are issued, in the Official Journal of the Federation (DOF).
The agreement for its extinction, approved since October 2020, was in charge of the Ministry of Finance and the Secretariat of Security and Citizen Protection (SSPC).

This action was carried out considering the addition of article 30 Bis to the Organic Law of the Federal Public Administration, which states that:
“It is the responsibility of the Ministry of Security and Citizen Protection to conduct and execute at the federal level the civil protection policies and programs within the framework of the National Civil Protection System for the prevention, assistance, recovery and support to the population in disaster situations.”
It should be recalled that the Fund, in the words of the same government website, was “a financial instrument that aims to provide relief supplies and assistance in emergency situations, to respond in an immediate and timely manner to urgent needs for the protection of the life and health of the population, generated by the imminence, high probability or occurrence of a disturbing natural phenomenon.”

Likewise, in the publication within the DOF it was recalled that article 37 of the Federal Law on Budget and Financial Responsibility was also reformed, which explains that the budget for natural disasters will be under the disposition of the Ministry of Finance.
A bit of context: ASF detected ‘operational deficiencies’ in fonden’s 2019 resources
It reads as follows: “the exercise of resources to carry out preventive actions or to implement programmes and projects to deal with damage caused by natural phenomena shall be subject to the provisions established in the Expenditure Budget of the Federation, as well as to the provisions issued by the Ministry of Finance and Public Credit, and that such resources may be used to cover expenses that have accrued in accordance with the aforementioned purposes”.
In order to pass the responsibilities of the Fonden into the hands of the Ministry of Security and Finance, the Agreement issuing the General Rules of the Natural Disaster Fund, published in the DOF on December 3, 2010, was abrogated.
This repeals the Fund’s specific Operating Guidelines, as well as the provisions or guidelines that emanated from the Agreement that is being abrogated.

Likewise, the programs of works and actions authorized and initiated before the entry into force of the Agreement must be concluded, and their execution will be the responsibility of the corresponding dependencies and entities, the publication indicates.
“The required procedures will be attended by the Secretariat of Security and Citizen Protection within the scope of its competence,” it reads.
Disappearance announced
Fonden’s demise had been considered since 2020, when President Andrés Manuel López Obrador referred to it as the “petty cash” for officials. 
“There are enough elements to maintain that it was a ‘petty cash,’ well not so small, for officials who bought everything taking advantage of the fact that there was an emergency without bidding, billions of pesos in cots, zinc sheets, in everything, at very high prices,” he said at the morning conference on 7 October.
The president defended the proposal to eliminate 109 funds and trusts, including the Fonden.
He insisted that the extinction would not affect the beneficiaries, but that the corresponding secretariats would be in charge of providing support for the care of those affected.
“We have to support the victims. How are we going to do it? That is what the Ministry of Finance is for, the Secretariat of Welfare, that is what the Directorate of Civil Protection is for, that is what the Secretariat of the Navy is for, the DNIII plan.”
