translated from Spanish: The Gondola Law will also apply to electronic commerce

The Ministry of Domestic Trade regulated the Gondola Law for the virtual stores of the large supermarket chains. It did so through resolution 926/2021, published this Friday in the Bulletin Oficial.La regulation establishes that the web pages of supermarkets, in the first instance, must order the products of each category from lowest to highest according to their price per unit of measure. Thus, consumers will be able to first visualize the most accessible products.

This ordering should be the default option for virtual stores, which may also include other sorting alternatives available for the personalization of each user. In addition, the sites will be obliged to indicate the lowest priced product within a category with a logo previously approved by Internal Trade. Thus, if the consumer chooses an ordering option different from that determined by law, he or she can also easily view the cheapest product per unit of measurement. The third issue added by this regulation is the identification of products manufactured by micro and small enterprises (MSMEs). In this sense, the offer of products made by MSMEs, family, peasant and indigenous agriculture should be highlighted on the websites of supermarkets; popular economy, cooperatives and mutual associations, also with specific signage approved by the area led by Paula Español.

Regarding the obligation to differentiate the goods with the lowest price such as MSME products, it is the same with respect to the regulation of the Law of Gondolas for physical stores. In addition, the same signage will be used in virtual stores and in sales halls to facilitate visualization by consumers. Those who are covered by the regulations have a period of 60 calendar days to adapt their virtual locations to the obligations dictated by the measure. The application of the Virtual Gondola Law will be given in this way:
The products in each category must be ordered from lowest to highest according to their price per unit of measurement.
Consumers will be able to see the cheapest products first.
The offer of products manufactured by micro and small companies will be highlighted.
Websites should distinguish MSME products and those with lower prices with specific signage.
The subjects reached have a period of 60 days to adapt their virtual locations.
