Sentence reduced to accused for fire in San Pablo station of the Santiago Metro, for “erroneous application of the law”

The Supreme Court decided to reduce the sentence applied to a person who received a conviction for the fire of the San Pablo station of the Santiago Metro, which occurred on October 19, 2019 during the so-called social outbreak.

The decision was adopted unanimously by the Second Chamber of the country’s highest court, composed of Ministers Haroldo Brito, Jorge Dahm and Leopoldo Llanos, Minister María Teresa Letelier and member lawyer Diego Munita. The determination was based on the fact that an error was established in the first-degree sentence, pronounced by the First Court of Oral Trial in criminal matters of Santiago in April of this year.
In it, Daniel Bustos Trabol was sentenced to 12 years in prison, based on an article of the Criminal Code that is repealed.
In this way, the Chamber partially accepted an appeal for annulment filed by the defense of Bustos Trabol. It is represented by the lawyers of the Metropolitan Regional Ombudsman’s Office (DRMN) Camila Valenzuela and Marcelo Jerez.
Thus, the sentence was reduced to ten years of major imprisonment in its minimum degree. The determination was adopted on Friday, September 2.
“The appeal for annulment filed by the Ombudsman’s Office was accepted. The Chamber considered that the First Court of Oral Trial of Santiago had made an erroneous application of the law at the time of applying the sentence, since it did not consider the current regulations and that it was more beneficial for my represented. This resulted in the highest court reducing the sentence imposed,” explained defender Valenzuela.
