Cabeza de Vaca wins appeal against arrest warrant

The former governor of Tamaulipas Francisco García Cabeza de Vaca obtained a provisional suspension, before an arrest warrant against him.
The head of the Eighth District Court in Tamaulipas resolved when granting the measure that if the crime for which the arrest warrant was issued does not require informal preventive detention, things will remain in the current state and the former president will not be arrested until the final suspension is resolved.
“In the event that the offence does require informal pretrial detention, the provisional suspension requested is granted for the sole effect that once the act claimed is executed, the impetrante of amparo is at the disposal of this District Court in the place where he is detained, as far as his personal freedom is concerned, remaining at the disposal of the responsible authority for the continuation of the procedure, until the final suspension is decided,” the judge ruled.

In addition, the judge demanded that Cabeza de Vaca pay a guarantee of 50,000 pesos within five days.
“The arrest warrant and its execution may be carried out if it was issued for a crime that merits informal preventive detention, likewise, it may be executed if this Court does not inform the responsible authorities, by means of an official letter, that in the aforementioned term, the required guarantee was deposited,” said the judge.
On October 6, the Undersecretary of Security, Ricardo Mejía, reported that the new arrest warrant against former Governor Cabeza de Vaca is for organized crime (a crime that merits informal preventive detention) and money laundering.

Once his term as governor ended on October 4, the National Institute of Migration issued a red migratory alert card to prevent the escape of Cabeza de Vaca.
Through a statement, Migration reported that “the Attorney General’s Office (FGR) requested intervention for the implementation of this measure, as there is an arrest warrant against him issued by a district judge for his probable intervention in criminal acts.”
Faced with the news, Francisco García Cabeza de Vaca wrote on his social networks that “I learn of the alleged arrest warrant and immigration alert against me. I am not surprised by this new barrage in political persecution. The government is in dire need of distractions. My defence will provide the relevant information. Stop persecuting opponents.”
For its part, the National Action Party (PAN), where he was a member, reported that it “condemns the political persecution that the Moreno government carries out against the former governor. We demand respect for the presumption of innocence, due process, that justice be impartial and not used with political overtones, much less as political revenge.”
