Transfer of the National Guard to Sedena Stopped Again

A federal judge granted a new definitive suspension that stops the operational and financial transfer of the National Guard to the Secretariat of National Defense (Sedena).
The resolution of the head of the Ninth District Court of Guanajuato orders not only to avoid the transfer of the security corps to the Army, decreed since last September 9, but also that the resources transferred to the Defense must be returned.
“Do not transfer the operational and administrative control of the National Guard to the Ministry of National Defense, and said agency continues under the command of the Secretariat of Security and Citizen Protection, as prescribed by Article 21 of the Constitution,” orders the suspension published on Monday.

In addition to ordering the Secretariats of Security and Citizen Protection and National Defense to “immediately” suspend the transfer of budgetary, financial and material resources, “all resources must be returned,” in case the transfer has already begun.
The judge argued that the decision “does not cause harm to the social interest or public order,” because the functions of the National Guard in public security tasks are not hindered, since “it will only continue under civilian command, as established by the Constitution”:
It even asks the Secretary of Finance and Public Credit to notify them so that they can return the resources that have already been granted to Sedena by the civilian command; He gave a deadline of three for the authorities involved to report compliance with the suspension.

If the suspension is disobeyed, the judge pointed out that economic fines and even a penalty of three to nine years in prison, “dismissal and disqualification from holding another public position, employment or commission, can be imposed on the public servant who does not obey a duly notified suspension order.”
This new resolution comes five days after a federal court in Guanajuato revoked a provisional suspension to stop the operational transfer to the Army.
The justices determined that the complaint filed by the federal government was well-founded and revoked the suspension previously granted by the judge who now issues a new suspension in the case.
In addition, they argued that whoever had promoted the appeal did not prove that the transfer of the National Guard to the Sedena caused him a direct grievance.
