Deputy Adriana Hernández Seeks Greater Penalties for Family Violence

Morelia, Michoacán. – Local deputy Adriana Hernández Íñiguez pointed out that the duty of all legislators is to ensure the best interests of children and Michoacan families, so she presented an initiative to prevent family violence and seek greater sanctions for it, they reported through a statement.
“Fulfilling my duty as a deputy to protect the best interests of children and the well-being of Michoacan families, I propose to incorporate into the State Criminal Code the crime of family fraud, which provides for and punishes family violence; as well as describing in article 220 the behaviors considered as family violence, crimes that hurt our society so much.”
In the gallery of the legislative precinct, he explained that economic-patrimonial violence against the family is described within the criminal type of family violence, the most common conduct being non-compliance with maintenance obligations, a crime that is contemplated by the 32 states with different wordings and sanctions; in the case of Michoacán, article 178 of the catalogue of crimes states that “The crime of family violence is committed by anyone who carries out behaviors that attack physically, psychologically, patrimonially or economically”, which does not describe what each of these types of violence consist of, leaving to the arbitrator of the operators of the law the subjective interpretation to frame the crime of family violence, Therefore, a good number of these actions remain unpunished.

“Violence within the family is multifactorial and multidimensional, which is why various studies, forums have been carried out, initiatives have been presented and laws have been enacted that provide for and punish family violence. However, little has been legislated on the tricks used by those who exercise the type of economic-patrimonial violence, which undoubtedly negatively affects the subsistence of its members,” he said.
The PRI deputy added that by approving this initiative they would also be complying with the corresponding legislative harmonization as mandated in the Federal Charter derived from the constitutional reform on human rights of June 2011.
