Mayans questioned the “political performance” of the Court and affirmed that the Constitution of Formosa meets “all the requirements”

The head of senators of the Frente de Todos (FdT), José Mayans, questioned today the “political performance” of the Supreme Court and its interference in the provinces, referring to the ruling that prevented the elections in San Juan and the request to challenge the candidacy of Governor Gildo Insfrán, and warned that the highest court has a “clear political bias, thus moving away from the legal sphere and from what is established in the Constitution”. In the case of Formosa, Mayans said in statements to the program Sin Protocolo of that province that it is different from that of San Juan because the Constitution of that district “contemplates the possibility that citizens who run for public office are reelected, as long as they have the popular support expressed through the vote.” In that sense, he added that the Constitution of Formosa “since it complies with all the requirements established in the National Constitution,” ignoring that the republican system of government has as one of its basic principles the “periodicity in the functions.” It includes the republican system of government and the representative system, as stipulated in article 5 of the National Constitution. Therefore, there should be no objections in this regard, since it is a constitution in force for 20 years and that has been previously analyzed and validated by the court on other occasions, refusing to comment on it, “added the head of senators of the FdT. since they consider that this situation would lead to a certain defeat in the elections. Therefore, a political manipulation by the Court is denounced.” On the rulings of San Juan and Tucumán, he said: “It is stated that it was a request for certainty and protection. However, in taking these cases, the Court has acted as a court of first instance, when in fact the federal system, contemplated in the Constitution, gives jurisdiction to the provincial courts.” For this reason, for the head of senators of the FdT “this should first be exhausted the provincial instance, since this is fundamental in the federal system.” Each province has the power to establish its own constitution and any judicial claim must first be filed in the provincial territory, being resolved by the highest courts of justice,” he said. For Mayans, the highest court had a “political performance” with a “clear bias, thus moving away from the legal field and what is established in the Constitution.”
