The project was changed in its entirety. The resolution that was eventually endorsed indicates that the Guerrilla senator did not commit any irregularities, and only the National Election Commission (CNE) is ordered to repeat the application selection process (in which Salgado can re-participate and also win).

For example, the sentence endorsed by the majority states that the only elements against Salgado Macedonio are journalistic notes that have no probative value, and that the CNHJ has no power to hold the accused criminal responsibilities or presume that he committed a crime, however, that in the Guerrero Prosecutor’s Office there is an investigative folder against him for the crime of rape.
In a particular vote, Commissioner Zazil Carreras, rapporteur of the original draft, criticized the view that the majority of the CNHJ did not judge the case with a gender perspective.

“I believe that – in the light of what should have been the application of the criterion of judging with a gender perspective – there were more than enough elements to assert that the accused has committed acts of gender-based violence in the grievance of two women and that, consequently, it cannot be argued that he possesses good public fame, which should result in the disqualification of the accused and, therefore, the absolute restriction of his participation in any elective process as part of the electoral platform of this political institute, either in the state of Guerrero or at the federal level,” she said.
“Since the original draft submitted by the Presentation to my office was modified in terms of its scope by the majority position that dismissed our obligation to judge with a gender perspective, as well as grievances related to gender-based violence (…), it becomes necessary to cast the present reasoned vote, because it is imperative for me to state that I strongly reject the dismissal of grievances in the field of gender-based violence and the consequence that such actions have on the public fame of any person, especially those who aspire to a port of popular choice.”
In the end, Commissioner Carreras and Commissioner Rios agreed that, at the very least, the survey in Guerrero and the Elections Commission should carefully value the profile of whoever wins the exercise.
