INAI orders Conacyt to report on the budget of the Consultative Forum

The National Institute of Transparency, Access to Information and Protection of Personal Data (INAI) ordered the National Council of Science and Technology (Conacyt) to announce the budget for the Scientific and Technological Consultative Forum A.C., during the period from 2013 to 2018.
The INAI Plenary instructed the Council to deliver the documents, financial reports or reports in which the annual budget allocated to the Consultative Forum is observed, in that period.
In addition, you should look for documents, financial reports or reports on the annual budget from 2002 to 2012 and from 2019 to 2021, which include the amounts directed to “science and technology projects” and the item of “operating expenses”.

This review, indicated the INAI, should be done in all the administrative units that are competent, notifying the result of the search.

The resolution comes after a person requested the reports in which the annual budget allocated to the Scientific and Technological Consultative Forum A.C., from 2002 to 2021 is observed, but Conacyt indicated that the required information is reserved.

The applicant filed an appeal for review with the INAI.
In allegations, Conacyt explained that the financial reports in which the resources to the Consultative Forum appear, in that period, “constitute reserved information, since they are part of the evidence required by the ministerial authority in the investigation folder initiated on the occasion of the complaint of facts presented by Conacyt to the FGR.”
The INAI indicated, in a statement, that what this cause protects are the files formed by the FGR and not elements that could contribute to its investigations, such as, where appropriate, the documents, financial reports or reports in which the annual budget that the obligated subject allocated to the Scientific and Technological Consultative Forum A.C is observed.
When presenting the matter to the PLENARY of the INAI, Commissioner Francisco Javier Acuña Llamas warned that Conacyt cannot classify the required information as reserved, given that it is the exclusive power of the public prosecutor’s office of the federation to integrate the investigation folder and, in the specific case, the obligated subject does not have such powers.
It added that data on resources allocated to projects or programmes could not be denied.

The National Council of Science and Technology (Conacyt) has denounced academics and researchers of the Scientific and Technological Consultative Forum (FCCyT) for mismanagement.
The Attorney General’s Office has requested in the apprehension of 31 academics, accused by the current direction of Conacyt of three crimes: operations with resources of illicit origin, organized crime and embezzlement.
