the Chamber of Cassation decided by a split vote the sentence to four years and a half imprisonment against former President Carlos Menem for the payment of bonuses in their Governments between the years 1989 and 1999.de same way, cassation ordered sentence on Domingo Cavallo, former Minister of economy of the period, Menem, by the time of 3 years and a half. The ruling became known after the resolution of the same Chamber to acquit the former President by the passage of time in the case of arms smuggling to Ecuador and Croatia.
The judges of the tribunal, Eduardo Riggi, Ana María Figueroa and Ángela Ledesma, were responsible for giving opinion. Riggi understood that the schemes of the Defense were understandable, while the remaining judges were those who confirmed the sentence.
After being sentenced, going to prison?
Former President, 88 years, would not go to jail for two reasons: the first is that given his age and health, should be condemned, would fulfill the home detention. Prior to this, the Senate should vote for the impeachment of Menem, who today is a national Senator and therefore has legal immunity by the jurisdictions as well as the Argentine legislators.
Domingo Cavallo, near the prison the former Minister Cavallo does not have jurisdictions and therefore this decision leaves him on the verge of an eventual arrest. The last judicial alternative available is the file an extraordinary appeal to treat the conviction with the Supreme Court of Justice.
