During the presentation of the Working Group for the Analysis of the Crime of Femicide, the Attorney General of the Republic, Alejandro Gertz Manero, proposed a reform to the Federal Penal Code so that all violent killings of women are investigated as femicide.

He argued that by investigating any violent murder against a woman as a femicide, he would allow for sufficient punishment. 
“It does not change what you did, on the contrary, it ratifies it and supports it better,” Gertz clarified.
What the MEPs are proposing
The Femicide Approved Criminal Type Proposal was worked for months by the Working Group for the analysis of this crime. 
The group consists of 14 MEPs and 2 Members and have started their working meetings since last February.
In addition to the sentences of between 40 and 60 years in prison, the proposal proposes that (in addition to gender reasons) it is considered femicide where:
I. The victim exhibits signs of sexual violence of any kind;
II. The victim has been inflicted on infamous or degrading injuries or mutilations prior to or after deprivation of life or acts of necrophilia;
III. There is a history or data of any type of family, work, community, political or school violence of the active subject against the victim;
IV. There has been between the active subject and the victim kinship by inbreeding or affinity or a romantic, affective, labor relationship,
trusting or some other evidence of inequality or abuse of power between the aggressor and the victim;
V. There is data establishing that there were direct or indirect threats related to the criminal act, harassment or injury of the active subject against the victim;
VI. The victim has been incommunicado, whatever the time before deprivation of life;
VII. The body of the victim is exposed, dumped, deposited or displayed in a public place; Or
VIII. The active subject has forced the victim to carry out an activity or work or has exercised any form of exploitation on him.
In addition, the proposal provides that the expected penalties be increased by up to one third “if the crime is committed prior to providing narcotics or psychotropics to cause the victim’s unconsciousness”.
As well as the increase in prison sentence by up to one half “if the crime is committed by a public servant who is in charge of the prevention, prosecution or punishment of the crime or the execution of sentences, or by any private security service provider.
Finally, they propose that the public servant who “maliciously or maliciously hinders or negligently” the pursuit of justice be imposed on a prison term of three to eight years and 500 to 1,500 days a fine. “In addition, you will be dismissed and disabled for three to ten years to perform another public employment, office or commission.
“The legal framework needs to be improved”
The Member of Morena and a member of the working group, Lorena Villavicencio, pointed out that for the proposal to work, the country’s legal system must be improved.
In an interview for Animal Político, Villavicencio noted that “the operators of the justice system are not properly developing their work because they do not have the tools, they work in deplorable conditions but there is also corruption”.
Until this situation changed, the MEP said, “no change in the laws will work.” 
Villavicencio supported Gertz Manero’s proposal but insisted that more investment is needed in the justice system in order for the results of these projects to be reflected. 
It also recommended reviewing current protocols and infrastructure to increase the budget in 2021 for the investigation of all types of crimes.
