translated from Spanish: Yucatan rectifies and will abide by sentence for girl with disabilities

The Yucatan government will agree to take a sentence in favor of Elvia, a girl with a disability who sued her school in the state for discrimination, by not adjusting a room for her.
This, after learning that the Supreme Court of Justice of the Nation (SCJN) attracted the case, on October 14.
State authorities decided to follow orders from a federal judge who concluded that Elvia was discriminated against by educational authorities because of her disability.
At the end of 2019, Elvia sued the “Rodolfo Menéndez de la Peña” Primary School and the Ministry of Education of the Government of the State of Yucatan for refusing to take steps to adapt its classroom according to the indications given by its doctors.
Elvia is a low-size person with mobility difficulties. He lives with hypochondroplasia and genu varu: the bones of his body that should be long are short and thick, in addition they have fissures; he also has deflection of the spine and hip and his legs are arched.

Knowing that the @SCJN elvia’s case, the @educacionyuc was withdrawn from its review appeal and will now abide by the judgment.

On 29 November 2019, Judge Miriam de Jesús Cámara Patrón concluded that the defendant authorities had discriminated against the girl on the grounds of her disability, ordering them to submit within 10 days “an action plan concerning the structural modifications they intend to make on the educational campus to ensure accessibility” of both Elvia and “any other person with disabilities”.
In addition, it ordered them to submit an action plan to provide “training workshops for campus staff and a programme of talks to be given to students and parents of that school, both on the issue of treatment of persons with disabilities”, including the disability with which Elvia lives.
However, both the defendant school and state authorities decided to file a review appeal with the aim of having a Yucatan-based Collegiate Court overturn the judgment.
According to lawyers in the case, the First Chamber of the Court decided that it should resolve the case directly because of its relevance, as it could issue novel criteria on reasonable adjustment issues for persons with disabilities, as well as make people with hypochondroplasia visible in Mexico.
The legal team accompanying Elvia’s case requested that the Yucatan authorities publicly clarify whether the withdrawal means institutional recognition of the mistakes made, and they also expect a pronouncement by the Court in the case.
