Commission of Justice Systems of the CC approves three norms that include the prevention of gender violence and the integration of feminist justice

During this week, the Justice Systems Commission of the Constitutional Convention (CC) approved in general three norms that seek to eradicate violence and discrimination against women and diversities in different social and institutional areas.
The first initiative supported by the commission is the one that establishes the right to a life free of violence against women, girls and sex-generic dissidents. Specifically, this law aims to prevent, punish, repair and eradicate all types of aggression based on gender, “whether committed by individuals, the State, its agents or members”.
The norm also integrates an intersectional perspective, since it establishes that the situation of vulnerability of the victim must be considered “in which they may be found due to their age, marital status, ethnicity, language, religion or belief, ideology or political or other opinion, national or social origin, filiation, among others”.
The proposal was adopted by 7 votes in favour, with 2 abstentions.
Secondly, the Feminist Justice initiative was discussed, which seeks to integrate a gender, human rights and intersectional perspective to all judicial administration bodies.
In addition, it is established that all officials who work in judicial processes must be trained, “in order to implement, in the exercise of their functions, the gender approach in a transversal manner”. This rule was approved with 14 votes in favor, 3 against and 2 abstentions.
Finally, the commission was informed of the proposal that creates special courts for gender violence, systems for monitoring precautionary measures, and establishes comprehensive reparations for victims of this type of aggression.
The initiative also contemplates that persons who violate the law, who have in their care minor daughters or sons, elderly or sick people, can serve alternative sentences to deprivation of liberty, except in those cases established by law. In such situations, necessary measures shall be taken to ensure the dignity and rights of persons deprived of their liberty.
This rule was approved with 14 votes in favor, 4 against and 1 abstention.
Now the commission will deliver a systematized text that includes the approved initiatives and a deadline will be opened, until February 3 to deliver indications.
