Government of Puebla files appeal to stop amparo in favor of abortion

The government of Puebla filed an appeal for review against the amparo that seeks to avoid criminalization of people who perform an abortion.
Melissa Ayala, lawyer of the Group of Information on Chosen Reproduction (GIRE), one of the associations that participated in the amparo, explained to Animal Político that the appeal for review denounces that “the organizations that presented it should not allow us to refute these rules.”
“They also point out that the local constitution protects the right to life from conception so this would prevent it from being able to Terminate pregnancy and thirdly, it says that abortion should not be done in Puebla because contraceptives exist,” said GIRE’s lawyer.

The fact that self-procured abortion remains in the penal code contributes to the stigmatization and social criminalization of women and pregnant people who have abortions.

According to Melissa Ayala, this is a “very conservative” review resource. “We were surprised above all because the governor himself, Miguel Barbosa, had declared that Puebla was ready for the decriminalization of abortion and then with his actions he shows us another reality.”

Information from Manatí details that during the forum “The Right to decide beyond Congress” at the facilities of the State Human Rights Commission in Puebla, organizations denounced that although there are three initiatives in Congress to decriminalize abortion, the deputies still do not discuss them.
Amparo in favor of abortion in Puebla
A district judge granted the injunction for the interruption of pregnancy, arguing that the organizations have a legitimate interest in challenging articles that criminalize consensual and voluntary abortion.
In this amparo it was mentioned that it is a right of girls, women, adolescents and pregnant people, and that although it is true that the local Constitution speaks of the right to life from conception, under no circumstances should it be interpreted as an impediment to access to abortion.
