The Maradona case is reactivated: there will be a key hearing to confirm or reverse the trial

The Court of Appeals of San Isidro set for March 7 the key oral hearing that will define whether the cause for the death of Diego Armando Maradona finally reaches oral trial as a “homicide with eventual intent” or with a milder qualification for the eight health professionals accused who could end up sentenced to sentences of between 8 and 25 years. The Chamber III of the aforementioned court notified the parties that the hearing will be held that day from 11.30, although not in the courts of San Isidro, but virtually and through the Teams platform.Los accused for the death of the former footballer are those who had some degree of participation in the alleged “home hospitalization” carried out in the house of Tigre, where Diego finally died: the neurosurgeon Leopoldo Luciano Luque, the psychiatrist Agustina Cosachov, the psychologist Carlos Ángel Díaz, Nancy Edith Forlini, the nurses Gisella Dahiana Madrid and Ricardo Omar Almirón, his boss Mariano Perroni and the clinical doctor Pedro Pablo Di Spagna. The team of three prosecutors that composed especially for this complex cause the attorney general of San Isidro, John Broyad, which is composed of his deputy attorneys general, Patricio Ferrari and Cosme Iribarren, and the prosecutor of Benavídez, Laura Capra, accused the eight as co-authors of a “simple homicide with eventual intent”, with a penalty of between 8 and 25 years in prison. In turn, almost eight months ago the judge of Guarantees 2 of San Isidro, Orlando Abel Díaz, after the request of the team of prosecutors who instructed the case, raised the file to oral trial, but the defenses of the eight accused appealed that resolution and since then the case has been under the analysis of Chamber III of the Chamber of Appeals and Guarantees of San Isidro until in the last Hours the first movement emerged. It will be the chambers Gustavo Adrián Herbel and Carlos Fabián Blanco -and if there is dissidence, Ernesto García Maañón will join-, who will define the future of the eight health professionals, after this hearing scheduled for March 7. Only if the Chamber of San Isidro confirms everything acted in the instruction, the case will go to draw lots to designate the Oral Criminal Court of San Isidro that must judge, not before the second semester 2023, according to estimates, the accused. Maradona, one of the greatest figures in the history of world football, died at age 60 of pulmonary edema and heart failure on November 25, 2020 in a house in the private neighborhood of San Andrés, Tigre, where he was going through a questionable home hospitalization for his addiction to alcohol and after having undergone neurosurgery. The autopsy established that he died as a result of “acute pulmonary edema secondary to exacerbated chronic heart failure” and discovered in his heart a “dilated cardiomyopathy”. The chats between the accused made it clear that Maradona had been deteriorating for days, that he did not eat well, that he did not get out of bed and that he was edematized and with tachycardia, signs of heart failure that none of the treating professionals took seriously to prevent the outcome.
