The crime of dispossession is prevented with higher penalties: GPPES

Morelia, Michoacán. – “The care of our elderly also implies protecting their heritage and properties,” emphasized Deputy Luz María García, of the Solidarity Encounter Party (PES) who urged the Congress of Michoacán, to impose higher penalties on those who commit the crime of dispossession, they reported through a statement.
Indicated in Article 226 of the Michoacán Penal Code, dispossession is the usurpation or illegitimate occupation of a property, lot or property that by right corresponds to another person; An act that unfortunately persists in the state and affects the elderly, due to factors that make them vulnerable: age, their state of health, their physical, psychological or emotional fragility.
The PES legislator proposed in March of this year, an initiative to increase the penalty from 3 to 8 years in prison for whoever is guilty of this crime, however, the PES Parliamentary Group is still waiting for the 75th Legislature to analyze and rule on its proposal.

“To prevent this practice, real legislative action is needed. Dispossession is a clear violation of Human and Patrimonial Rights, and it is even more unfortunate when the victims are the elderly and it is their own relatives or children who affect them,” he said.
In this sense, the deputy urged her fellow deputies to streamline the study and analysis of this and other initiatives presented by the PES, which seek to safeguard the rights of all family members.
The law in force in the state of Michoacán indicates that those who direct the invasion of the property will be imposed from one to four years in prison.
