Susana Giménez won a million-dollar lawsuit against the AFIP

The Federal Court of Criminal Cassation rejected an appeal by the AFIP for considering the crime attributed to Susana Giménez for alleged evasion of the payment of at least 50 million pesos in taxes on Personal Assets for 2019 non-existent. There was a “ruse” on the part of the star to defraud the Treasury. According to the judge’s understanding, Susana did not behave in a “deceitful or arduous manner in the strict terms required by criminal law.” In September 2023, the Federal Administration of Public Revenue appealed the ruling of the Chamber of the Economic Criminal Court, and today, the country’s highest federal criminal court rejected the prosecutor’s accusation “for not constituting a crime”, and ratified the previous ruling. The opinion of Judge Javier Carbajo, to which Carlos Mahiques adhered, held that AFIP “limits the expression of its grievances to mere judgments dissenting from the decision whose challenge it postulates, all of which is not enough to distort the reasoning that the Chamber made on the matter and whose grounds it fails to refute,” reads the ruling. And it adds: “The impugned pronouncement has been issued by the Court of Appeals in its capacity as a reviewing body of the decisions issued by the magistrates, that is to say that in the case there is double judicial conformity. Finally, it is not noted that the petitioner has been able to prove the existence of a federal issue of sufficient importance, nor the concurrence of any circumstance that imposes the authorization of the jurisdiction of this Federal Court of Criminal Cassation as an intermediate court, in accordance with the guidelines established by the High Court.” However, the AFIP could file an extraordinary appeal with the Supreme Court of Justice as a last resort.
