Jesus Hernandez’s Lawyer Says a Third Shot Yrma Lydya

Ángel Fernando Hernández Guadarrama, lawyer of Jesús Hernández Alcocer, accused of the femicide of Yrma Lydya, said that it was not the singer’s husband who shot her in a restaurant in Mexico City, on June 23, but a third close to them.
He said that the person responsible for the murder Yrma Lydya was “an alien shooter” whom the defense has already identified and is accredited in a video.
“There has been talk of a shooter totally alien to him, this person is not an extortionist, he has been fully identified, in due course it will come to light. He has also been identified by witnesses,” he said in an interview with Ciro Gómez Leyva on Radio Fórmula.

The lawyer said that before the events the person who shot the woman first had an argument with Yrma Lydya and then with the two. “This is not an occurrence of the defense or Jesus Hernandez, this is fully accredited in videos.”
According to the defense, the video provided by the Suntory restaurant is altered because the Mexico City Prosecutor’s Office did not take care of the chain of custody.

He indicated that the video is cut for minutes and seconds at different times, but it is possible to perceive that a third person entered the private room in which the couple ate.
“It is clear that there is another person entering the private, you can not see, you can not see exactly who is shooting for a simple reason, the cameras and the private are closed. Mind you, what was discovered is that there are witnesses.”
However, the general coordinator of investigation of gender crimes and attention to victims of the Attorney General’s Office of Mexico City (FGJCDMX), Laura Angelina Borbolla, told the same media that in the videos it is not appreciated that any other person has entered.
“The statements of many of the witnesses we have establish that the two of them were in a specific place in the restaurant, that they were only there. It is not seen in the videos that any other person has entered, as referred to by the defense. He has referred in a very generic way that it is a third party that the two know, but he has not established the name, data and so on. That is, he has not proven what he intends to be his theory of the case, “said Laura Angelina Borbolla.
The official said that during the hearing last Thursday, June 30, the control judge decided not to continue watching the videos presented as new evidence by the defendant’s defense because they are the same materials provided by the restaurant that are already part of the investigation folder.
The weapon 
Fernández Alcocer’s defense commented that the gun, owned by his client, which the prosecution presented as a murder weapon, does not correspond to the bullets that killed the victim. In addition, he charged that the weapon was obtained at the defendant’s home without a search warrant.
In this regard, the coordinator of investigation of gender crimes explained that Jesús Hernández Alcocer, did not give his authorization to be tested for sodium rhodizonate, which can be used to identify the person who fired a weapon, so the Prosecutor’s Office of the CDMX had to opt for other tests that allow identifying the victim-victimizer position and the trajectory of the shot.
He also denied the claim that the warheads on the victim’s body do not correspond to the pistol presented by the Prosecutor’s Office of CDMX as a murder weapon; He assured that the way in which it was obtained inside his home was legal even if it was not through a search warrant since everything was supported under the laws of the Criminal Code.
The official of the Prosecutor’s Office reiterated that there is evidence about the responsibility of Hernández Alcocer and two people who work as his assistants, without the defense having managed to deny this version and prove the innocence of his client.
“The flagrante delicto was stopped” 
The Secretary of Citizen Security of Mexico City, Omar García Harfuch, said in an interview on W Radio that the arrest of the alleged femicide of Yrma Lydya was in flagrante delicto and was made seconds after the detonations, so the elements of the Secretariat of Citizen Security will declare in due course.
He explained that it was an element of the agency that entered the place after hearing the detonations arresting in flagrante delicto of who is indicated as femicide.
Yesterday a judge decided to link Jesús Hernández Alcocer to trial. A judge at Reclusorio Oriente ordered a 4-month deadline for the investigations into the murder of Yrma Lydya to conclude.
