Cristina Fernández insisted on the dismissal of Judge Capuchetti in the case

After Judge María Eugenia Capuchetti refused to step aside from the case investigating the attempted murder of Vice President Cristina Fernández de Kirchner, the former president again insisted that the continuity of the judge at the head of the investigation is “unsustainable” and in a video through social networks presented “new and very serious irregularities” of the judicial official around the cause.

In the four-minute video, which is voiced by journalist Julia Mengolini, the Vice President presented her recusal arguments against Judge Capuchetti. “On Monday, Cristina challenged Judge Capuchetti in the case investigating the attempted murder. The investigation started very badly. A few hours after the attack and under the custody of Capuchetti, the contents of the cell phone of (Fernando) Sabag Montiel, the murderer who fired the weapon 15 centimeters from Cristina’s face, were destroyed and deleted,” the audiovisual material begins. In turn, she recalls that “during the government of Mauricio Macri and before being appointed to office, Capuchetti was a regular visitor to the Federal Intelligence Agency (AFI). In those years the AFI was commanded by Gustavo Arribas and Silvia Majdalani, both currently prosecuted for espionage on the Instituto Patria, Cristina’s offices,” he said. He added: “As if this were not enough, it was known from the Bicameral Intelligence Commission that Capuchetti’s sister worked in the wiretapping area of the Counterintelligence Directorate during the same period in which illegal espionage was developed.” In addition, the recusal presented by Fernández de Kirchner indicated “a fact that sows even more suspicion: in the first days of the investigation, after a meeting between judges and chambers of Comodoro Py, Capuchetti would have received indications regarding how he should treat the case in the media and the possible lines of investigation.” After that meeting, her colleagues arranged a meeting with the general editor of Diario Clarín, Ricardo Roa, to which the judge attended accompanied,” the video details. And he adds about the journalist: “Ricardo Roa, the editor-in-chief who, a few hours after the attack, had already invented the theory of the spontaneous action of a loose madman.” Why were these instructions necessary? Does anyone type or opine behind the judicial authorities the course of the case, its communication and the successive leaks?”, questions the published video. During the audiovisual material uploaded to Twitter, the Vice President also reviewed other facts previously presented in the recusal of Capuchetti. Fernández de Kirchner recalled that for days the magistrate “delayed” the arrest of the accomplices of Fernando Sabag Montiel, and as he pondered “to that was added the paralysis of the case as soon as evidence appeared that links opposition leaders with the attack.” In addition, the video indicated that “Capuchetti rejected the requests for search and seizure of the cell phone of Hernán Carrol, a member of an extreme right-wing group, whom Sabag Montiel, in his own handwriting, indicated as ‘the person who would take charge of his situation and appoint his lawyers.'” And he explained: “Carrol, the same one who would have traveled abroad with the chief of staff of the Intelligence Directorate, in charge of the then Secretary of Security, Gerardo Milman,” he added, and noted that “when he summoned him to testify, it was already late,” because “the day before, Carrol had deleted all the contents of his cell phone.” In turn, the Vice President also focused on “the obsession” of the national deputy (PRO) Gerardo Milman “with security”, who had presented a project in which he “suspiciously” warned about a possible false attack against the former president. He said: “But he wasn’t the only one. On August 31, one day before the attack, he presented a request for reports to know the operation of the custody of the vice president and her family, the number of agents and vehicles assigned to each of their homes.” Why did Milman want to have access to such sensitive information about Cristina’s safety?” he questioned and answered: “We still don’t know because Capuchetti never investigated it.” He also said: “The judge also did not investigate a fundamental clue about the planning of the attack. During the search of Brenda Uliarte’s home, a handwritten note was found referring to the Tueller rule. What is the Tueller rule?”” It is a doctrine of security. It calculates the time a person has to draw a gun and shoot it without getting it out. It is taught to the security force in the United States and was brought as a novelty to Argentina by Patricia Bullrich, when Gerardo Milman was her deputy minister (of Security),” he explained. And he asked: “Did Capuchetti find it normal that a person like Brenda Uliarte had in his house a reference to such a specific and sophisticated technique?”, and he answered: “Apparently yes and that is why the judge never investigated who wrote that note, trained or trained them.” Finally, the video concluded: “All these facts detailed in the recusal are what make the continuity of Judge Capuchetti at the head of the investigation untenable.”
