Court suspends AMLO agreement that classified information from works

A Supreme Court minister granted a stay to prohibit the federal government from classifying public information about the works it builds as reserved for reasons of national security.
“The suspension is appropriate so that all the effects and consequences of the contested agreement that result in cataloging the information detailed in it as of public interest and / or national security are suspended, without complying with the assumptions that the respective laws provide for that purpose,” says part of the minister’s resolution, of which the Court did not publish a name.
This suspension was requested by the National Institute of Transparency, Access to Information and Protection of Personal Data.

The Agreement, published on November 22, indicates that priority projects and works will have provisional permits and will be classified as national security, so information about them cannot be obtained.

It also orders the agencies to grant the necessary permits to start the projects or works that are considered a priority for the government, to “guarantee their timely execution, the expected social benefit and the exercise of the authorized budgets.”

The INAI was dissatisfied before the Court because when the works of “national security” are considered, the dependencies and entities of the Federal Public Administration can reserve, in a general way, the information related to the projects and works, which would affect transparency.
President Andres Manuel Lopez Obrador said the agreement “has nothing to do with transparency, the secretariats, we are all held accountable.”

In his ruling, the investigating minister indicated that “the suspension measure granted will take effect immediately and without the need to grant any guarantee, without prejudice to the fact that it may be modified or revoked as a result of any supervening event.”
